넷플릭스 ‘나는 신이다’ JMS 정명석 편에서 성피해자(전 JMS 보고자)로 출연한 이가 대역 배우 였음이 밝혀졌다. ‘나는 신이다’는 다큐시리즈로 과거 MBC PD수첩에서 취재, 방송 되었던 내용에 인터뷰를 더하고 확장해 만든 다큐멘터리라고 알려져 있어 논란이 예상된다.

A씨에 따르면, 제작사측은 피해자 대역으로 출연하는 A씨의 초상권을 보호해주고, 자막에 ‘대역’임을 표기해 주기로 했다고 한다. 하지만 제작사측은 구두로 약속한 내용을 지키지 않고 실제 만들어진 넷플릭스 다큐에서는 A씨를 대역이 아닌 ‘성피해자, 전 JMS 보고자’로 자막처리해 내보냈다. 이로인해 A씨는 지인들에게 JMS 성 피해자로 오인받는 피해를 입었다.
하지만 A씨는 법적 피해보상을 받기 어려웠다. 제작사측이 구두로 설명한 ‘대역 표기’와 ‘음성변조’ 내용을 출연동의서에 넣지 않았기 때문이다. 계약서 문구를 자세히 살피지 못하고 제작사측의 말만 믿고 출연한 A씨는 고스란히 피해를 떠안게 됐다.
특히 넷플릭스 <나는 신이다>는 다큐멘터리로 알려져 있어, 대다수 시청자들은 출연자들이 실제 피해자라고 인식하게 되어 이로인해 A씨처럼 대역으로 출연하고도 자막에 ‘성 피해자’로 표기 되어 다큐멘터리 프로그램의 본질을 흐리게 하는 논란이 되고 있다. 게다가 이들은 MBC와 체결한 출연 동의서와 계약서의 불공정한 계약 조항과 비밀유지 조항 때문에 제대로 항의를 하지 못할 수 도 있다는 지적이다.

A씨는 MBC측에 수차례 항의 했으나 그때마다 담당피디는 회피하고, 외주 제작업체와 당시 배우 캐스팅을 담당한 에이전시 직원이 A씨에게 연락해 “피해 보상금을 원하는것이냐, 돈을 더 요구하는거면 돈을 주겠다, 자꾸 MBC쪽에 전화하면 소송하겠다.” 등등의 회유와 협박을 했다고 한다.
또 넷플릭스 코리아측에 항의 했으나 "넷플릭스 코리아는 이 부분에 대해서 도움을 줄 수 없으니 MBC측에 얘기하라"는 답변만 받았다.
A씨는 “넷플릭스 <나는 신이다> JMS정명석편에 대역으로 출연했는데, 제작사측이 성 피해자로 둔갑시켜 자막처리 했다.”며 “또 사실대로 바로잡아 달라고 MBC에 연락했더니, MBC측에서는 계속 돈을 요구하냐는 답변만 한다. 나는 한번도 돈을 요구한적이 없다"라고 호소했다.
이어 "내가 원하는것은 피해보상금이 아니라 케스팅 당시 약속한 대로 '대역' 이라고 표시해 주는 것이다. '성 피해자 전)JMS보고자' 자막을 빼고 '대역'이라는 문구를 넣어주고 음성변조 해서 내 신분이 노출되지 않도록 해주기 바란다"라며 "넷플릭스를 통해 <나는 신이다>편이 전세계로 퍼지고, 유튜브에도 '짤영상'으로 번지고 있어 영화관계자와 주변 지인들이 나를 JMS 피해자로 오인한다. 정신적 피해가 크다. 배우 이미지에도 타격을 받고 있고 배우 직업에도 피해를 입고 있다."라고 하소연했다.
A씨는 거짓이 아닌 사실대로, 자막에 피해자가 아닌 '대역'이라고 명확히 정정 표기해주길 원하고 있다.
법률관계자는 "A씨의 사정은 억울하고 안타깝지만, 상영금지 가처분 신청은 어려워 보인다. MBC측에서 지금이라도 잘못을 공표하고 수정해주면 좋겠지만 가능할지 모르겠다."라며 "계약서에 불공정 소지는 보인다. 계약사항을 면밀히 살펴 소송을 진행 하는 방법밖에 없어 보인다"라고 말했다.
